IDF: house owners will get 48-hour notice before demolition

The IDF told the High Court on Tuesday that it would give Palestinians whose houses were to be demolished 48-hours notice, so that they would able to petition the High Court.

The IDF’s undertaking does not apply to homes it determines have to be destroyed for operational reasons.

The IDF made this undertaking at a High Court deliberation on six petitions to prevent the demolition of some 40 houses in the Gaza Strip, most of them along the Kissufim road and near the settlement of Netzarim. The petitions were submitted by two Palestinian human rights organizations in the Gaza Strip, Hadash faction chairman MK Mohammed Barakeh, and dozens of Palestinian home owners, through attorneys Andre Rozental and Ihab Erekat.

The petitioners withdrew their petitions following the IDF’s declaration that it would allow them to appeal any future demolition plans.

During the deliberation the lawyers representing the petitioners complained that the IDF had recently demolished eight homes after petitions had already been submitted to the High Court.

In response to the claim that they found it hard to trust the IDF, Justice Dorner told the petitioners that, “There is no other Supreme Court in the world that discusses cases such as these, and this is something of which we can be proud.”
